Welcome to PetrolBuddy, located at petrolbuddy.net.au. These Terms and Conditions ("Terms") govern your use of the PetrolBuddy website and mobile application (collectively, the "Service"), owned and operated by WebDigital (ABN: 17 453 778 242).

By accessing or using PetrolBuddy, you agree to be bound by these Terms, our Privacy Policy, and any other additional terms and conditions and policies referenced herein. If you do not agree to all these Terms, do not access the Service.

1. Agreement to Terms

By using our Service, you represent that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and WebDigital (ABN: 17 453 778 242) regarding your use of PetrolBuddy.

2. Eligibility

To use PetrolBuddy, you must be at least 18 years of age. If you are between the ages of 15 and 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you warrant that you meet these eligibility requirements.

3. Account Registration

While some features of PetrolBuddy are available without an account, certain features (such as reporting petrol prices or saving favourite servos) require registration. You agree to:

Provide accurate, current, and complete information during the registration process.
Maintain the security of your password and accept all risks of unauthorised access to your account.
Notify us immediately at [email protected] if you discover or suspect any security breaches related to the Service.

4. Permitted and Prohibited Use

4.1 Permitted Use

You are granted a limited, non-exclusive, non-transferable licence to use PetrolBuddy for personal, non-commercial purposes to compare petrol prices from 8560+ servos across Australia, report prices, and navigate to your chosen servo.

4.2 Prohibited Use

You agree not to:

Use the Service for any illegal purpose or in violation of any Australian local, state, or federal law.
Submit false or misleading petrol price reports.
Data mine, scrape, or use robots to extract data from the Service without express written permission from WebDigital.
Interfere with the operation of the Service or any user’s enjoyment of it.
Use the Service while operating a vehicle (e.g., your ute or car) in a manner that violates Australian road safety laws. Always ensure your mobile device is in a legal cradle or used hands-free as per your state's rego and licensing requirements.

5. Petrol Price Data Accuracy Disclaimer

PetrolBuddy provides real-time petrol price comparisons from over 8560+ servos. While we strive for accuracy, petrol prices (expressed in c/L) change frequently. Data is sourced from third-party providers and user-generated reports. WebDigital (ABN: 17 453 778 242) does not warrant or guarantee the accuracy, completeness, or timeliness of any petrol price displayed. You acknowledge that the price at the pump at the servo may differ from the price shown on PetrolBuddy. Any reliance on the data provided is at your own risk.

6. Premium Services and Payments

PetrolBuddy is free to use and supported by advertisements. We offer an optional "Premium" version which removes ads and may provide additional features. This is a one-time purchase in AUD.

Payment Processing: All transactions are processed via RevenueCat and through the Apple App Store or Google Play Store.
Refunds: Since payments are handled by third-party app stores, any refund requests must be directed to Apple or Google according to their respective refund policies.
Pricing: Prices are displayed in Australian Dollars (AUD) and include GST where applicable.

7. Intellectual Property

The content on PetrolBuddy, including the logo, design, text, graphics, and software, is the property of WebDigital (ABN: 17 453 778 242) and is protected by Australian and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without express written consent.

8. Third-Party Services

We use third-party services to enhance your experience, including:

Google Analytics & Firebase: For performance monitoring and usage statistics.
Google AdMob: For displaying advertisements.
AppsFlyer: For marketing and attribution analytics.
RevenueCat: For managing premium subscriptions and purchases.

Your use of these services is subject to their respective terms and privacy policies. PetrolBuddy is not responsible for the content or practices of these third parties.

9. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and disclose your personal information. By using the Service, you consent to our collection and use of data as outlined in that policy.

10. Disclaimers and Limitation of Liability

10.1 Statutory Guarantees

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, which cannot be excluded.

10.2 Limitation of Liability

To the maximum extent permitted by law, WebDigital (ABN: 17 453 778 242) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues (whether incurred directly or indirectly), or any loss of data, use, or goodwill, resulting from:

Your access to or use of (or inability to access or use) the Service.
Any inaccuracies in petrol prices (c/L) provided by servos.
Any conduct or content of any third party on the Service.

11. Indemnification

You agree to indemnify and hold harmless WebDigital (ABN: 17 453 778 242) and its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your account or access to PetrolBuddy at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia and the state in which WebDigital is registered. You submit to the non-exclusive jurisdiction of the courts of Australia for the resolution of any disputes.

14. General Provisions

If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right.

15. Changes to Terms

We may modify these Terms at any time. If we make changes, we will notify you by revising the "Effective Date" at the top of this page. Your continued use of PetrolBuddy after such changes constitutes your acceptance of the new Terms.
